QualitySolicitors Lockings, in Hull and Beverley are witnessing progress in relation to the reform of the controversial pre-nuptial agreement.
UK law regarding this agreement has been the cause of debate for many years, as opinion says that it undermines the sanctity of marriage.
Paul Kirby, family solicitor from QualitySolicitors Lockings says: “The Law Commission recently published a consultation which seeks the views as to whether couples should be free to decide how finances might be shared should their marriage breakdown in the future. The case that really tipped the scale last year was the English Supreme Court’s 2010 decision on Radmacher v Granatino – where the agreement was upheld in favour of the wealthier wife.”
“My clients sometimes ask about pre-nups, seemingly out of curiosity. The question appears to be a moral one, as to whether marriage should be entered into with the consideration of divorce from the start.”
“The Law Commission is however, reviewing it and at some point I believe it will be acceptable for couples. Children though, are always top priority in any divorce case, and it remains to be seen what conditions the Law Commission recommends should be met before a pre-nup is irrevocable.”
